Terms

Evendraft is a trading name of Madhvan Sharma, based in India (“Evendraft”, “I”). Contact: sharma01madhvan@gmail.com. Evendraft is not a UK company and has no UK office.

These terms apply to every order for a Bid Red-Team, Deadline Pack Lite or Deadline Pack Standard, founding pilot, Prepaid 3-pack, Interim Bid Writer seat or overflow drafting. Each order is confirmed in writing (the “order confirmation”) with the product, the tender, the word band, the fee, the inputs date and the delivery date. If the order confirmation and these terms disagree, the order confirmation wins. The free bid/no-bid memo is given without charge and without obligation on either side.

• Fees are fixed and in pounds sterling, as set out on the prices page at the date of the order confirmation.
• Every order is paid in full before work starts, against an invoice. How to pay: UK bank transfer in pounds; details on the invoice.
• No VAT is added. The service is supplied from outside the UK to a business customer, who accounts for any UK VAT under the reverse charge where it applies.
• A Bid Red-Team fee is credited in full against a Deadline Pack ordered within 30 days of the Red-Team delivery.
• A prepaid 3-pack is available after your first Deadline Pack. It is non-refundable and valid for 12 months from payment; unused packs expire.
• The Interim Bid Writer seat has a three-month minimum on the monthly price, or is paid for a quarter in advance. After the minimum it continues monthly until either side gives at least 30 days’ notice in writing, taking effect at the end of a billing period. A prepaid quarter is not refundable if it is ended early.

The delivery date in the order confirmation depends on your inputs arriving by the inputs date. If they arrive late, the delivery date moves back by the same number of working days, and the new date is confirmed in writing. If the buyer changes the tender deadline, we agree new dates with you at no extra cost. If the buyer brings the deadline forward, we do what we reasonably can, but cannot guarantee the original scope. Working days are Monday to Friday, excluding bank holidays where the buyer is based.

A Deadline Pack and a founding pilot include one round of revisions, made from one consolidated set of your comments received by the date in the timetable. Further rounds, or changes of scope (for example a larger word count or extra lots), need a new quote.

• You check every factual claim in the deliverables and confirm or correct it in the claims table. The final files are produced only after that sign-off.
• You set the price, sign all declarations and submit through the portal. Evendraft never holds portal logins and never contacts the buyer or evaluators for you.
• You make sure the tender’s terms allow you to share its documents with an adviser bound by confidentiality, and you provide only information you are entitled to share.
• You decide whether to submit the bid, and you are responsible for what it says.

Evendraft does not guarantee that any bid will pass, score well or win, and charges no success fee. Self-scores are judgements, not predictions. The fee is for the work described in the order confirmation, whatever the result.

Drafting uses AI tools, as described on the How we work page. Each deliverable includes a short note on how AI tools were used, which you may adapt if the buyer asks. Answering any such question truthfully is your responsibility.

Content touching TUPE, employment, legal, tax, insurance or financial matters is drafting for you and your advisers to check. It is not legal, tax or financial advice.

Each side keeps the other’s confidential information confidential and uses it only for the order, under the mutual NDA signed before any documents are shared. Evendraft does not work for two bidders on the same lot of the same tender. A founding pilot’s testimonial and anonymised answer are published only with your written approval of the final text, and an answer only after the contract award and standstill period.

For personal data inside your bid material, you are the controller and Evendraft is your processor under a data processing agreement, with an International Data Transfer Agreement for transfers to India. Client files are deleted 30 days after the tender deadline unless you ask in writing for an answer library to be kept. Once the fee is paid, you own the deliverables written for you. Evendraft keeps its own templates, methods and general know-how, and does not reuse your content for anyone else.

Evendraft’s total liability for an order, however it arises, is capped at the fee paid for that order; for the Interim Bid Writer seat, at the fees paid for the three months before the event giving rise to the claim. Evendraft is not liable for loss of a contract, profit, revenue or opportunity, or for any indirect loss. Nothing in these terms limits liability that cannot be limited by law.

If you cancel before the kick-off call, the fee is refunded in full. After the kick-off call there is no refund; if the buyer then cancels or postpones the procurement, what you paid is credited against another tender ordered within six months. If Evendraft misses the delivery date for a reason within its control, when your inputs arrived on time, you can choose a full refund of that order or accept late delivery.

These terms are governed by the law of England and Wales, and the courts of England and Wales have jurisdiction over any dispute.

These terms may be updated. The version that applies to an order is the one in force on the date of its order confirmation.
